LEGISLATIVE UPDATE - July 16, 2007

State did not pass legislation prohibiting cell phone use while driving

Many constituents have been concerned about an e- mail, apparently originating from the governor's office, outlining penalties for various driving violations.

The contents within the e-mail are false. The Georgia General Assembly did not pass any legislation reflecting the penalties stipulated within the e- mail.

During this past legislative session, members of the House did introduce HB 5 which would add a points penalty for the use of cellular, hands-free, or mobile telephones or other wireless communication devices under certain circumstances. HB 5 did not pass out of committee.

Yet, I am concerned about the issue. According to a study conducted at the University of Illinois, research shows that people have greater difficultly maintaining a fixed speed, or keeping their car safe in a single lane when performing tasks that simulated conversing on a mobile phone, than if they were driving without the distraction. Contrary to expectation, the speaking and listening were equally distracting.

Peach Care Available to Children Again:

The Community Board of Health has lifted its freeze on applications for the PeachCare and set a new cap on enrollment of 295,000 children.

The board's unanimous action allows the state to address a backlog of 22,000 applications.

I am a strong supporter of PeachCare and believe in its mission to provide quality healthcare to the children of hardworking parents.

Members of the Georgia Legislative Black Caucus, including myself, went to Washington D.C. to speak with members of Congress about how vital PeachCare was to our state. Fortunately, Congress was able to appropriate the necessary funds to support the program for several more years.

Health care should not be enjoyed by only the few, but be made available to all people who work hard and support their families.
